The petitioner seeks bail in connection with Darbhanga Sadar P.S. Case No. 268 of 2022 instituted for the offence under Sections 341, 323, 324, 354, 504/34 of the Indian Penal Code.

As per prosecution case, there is allegation against the accused persons, including the petitioner, that they have assaulted the informant by various means.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 01-09-2023. Petitioner bear no criminal antecedents.

It has been further submitted by the petitioner's

Patna High Court CR. MISC. No.78420 of 2023(2) dt.06-12-2023 2/2 counsel that petitioner has been falsely implicated in the present case. As per prosecution case, Section 354 of the IPC is not applicable to the petitioner.

Learned A.P.P. for the State has vehemently opposed the prayer for grant of bail to the petitioner. 7.

Considering the aforesaid facts and circumstances of the case and period of custody of the petitioner, this Court is inclined to grant bail to the petitioner.

Let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Court below/concerned Court in connection with Darbhanga Sadar P.S. Case No. 268 of 2022.
