The petitioner is apprehending his arrest in connection with Dumara P.S. Case No.101 of 2019, registered for the offence under Section 414 of the Indian Penal Code. Accusation against the petitioner is that on secret information that one person, namely, Manoj Kumar Singh, who resides in a rented house of Dabloo, had kept a stolen motorcycle in front of D.A.V. School, Bhisa, Sitamarhi, the informant conducted a raid and found a motorcycle, bearing Registration No. G4P-5253, standing by the side of main road and on demand of the said motorcycle, the wife of the accused did not produce any paper.

It is submitted by learned counsel for the petitioner

Patna High Court CR. MISC. No.67341 of 2019(3) dt.18-11-2019 2/2 that the petitioner has falsely been implicated in the present case. He submits that a supplementary affidavit has been filed on behalf of the petitioner as per earlier order, in which it has been stated that an unclaimed motorcycle was standing by the side of the main road and the petitioner has no concerned with the said motorcycle.

Learned Addl.Public Prosecutor has opposed the prayer for anticipatory bail.

Considering the facts and circumstances of the case, let the petitioner, above named, in the event of his arrest or surrender within a period of six weeks from the date of receipt of the order, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Sitamarhi in connection with Dumara P.S. Case No.101 of 2019, subject to conditions as laid down under Section 438(2) Cr.P.C. (Anjani Kumar Sharan, J.) nawalkrs/- U T
