The petitioner seeks regular bail in connection with Nautan P.S. Case No. 144 of 2019 registered for the offence punishable under Sections 147, 148, 149, 323, 324, 307, 348, 504 and 34 of the Indian Penal Code.

The allegation against the petitioner is that the petitioner assaulted the informant by means of farsa on his head.

Learned counsel for the petitioner submits that petitioner has falsely been implicated in this case inasmuch as the family members of the petitioner had donated a piece of land to the Waqf Board for construction of mosque and the side of the informant and others were trying to grab the said land donated

Learned counsel further submits that the injuries caused to the informant have been found to be simple in nature, as would be evident from Annexure- 2 series to the petition. Learned counsel for the petitioner submits that petitioner is in custody since 10/09/2019.

Having regard to the submissions made by the parties and taking into consideration the fact that both the parties are co-villagers, injuries caused to the informant have been found to be simple in nature and the petitioner is in custody since 10/09/2019, I am inclined to enlarge the petitioner on regular bail.

Accordingly, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs. 20,000/- (twenty thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate Ist Class, Siwan in connection with Nautan P.S. Case No. 144 of 2019. (Anil Kumar Sinha, J) praful/- U T
