2. The present criminal miscellaneous application has been filed under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (hereinafter referred to as 'the BNSS, 2023') for grant of anticipatory bail to the petitioner who apprehends arrest in connection with Excise Piro P.S. Case No. 113 of 2024, lodged on 08.09.2024, under Sections 30(a)/(c)/(d)/36 of the Bihar Prohibition and Excise (Amendment) Act, 2018.

3. As per the prosecution, total recovery of 4,881.780 liters of foreign liquor, 760 liters of spirit, 520 piece empty bottles and other materials have been the subject matter of the present case. The said materials have been recovered from the house of the apprehended accused persons. It has been disclosed

Patna High Court CR. MISC. No.79593 of 2024(3) dt.09-04-2025 2/2 by the apprehended accused persons that they are doing the business in partnership in which the present petitioner is one of the partners.

4. Learned Counsel for the petitioner submits that the petitioner is innocent and has committed no offence. Counsel submits that antecedent of the petitioner is not clean and there is one criminal antecedent of similar nature against the petitioner. Counsel submits that he is ready to fulfill all the conditions whatsoever shall be imposed upon him.

5. Learned APP for the State opposes the prayer for anticipatory bail of the petitioner and submits that antecedent of the petitioner is not clean. There is one criminal case of identical nature is pending against the petitioner.

6. Considering the identical criminal antecedent of the petitioner, the prayer for anticipatory bail is hereby rejected. However, in the event of surrender of the petitioner within four weeks from today, the prayer for regular bail shall be considered without being prejudiced by the order of this Court.
