Petitioner, already in custody, seeks bail in connection with Pakaridayal P.S. Case No. 04 of 2017, registered under Sections 30 and 36 of the Bihar Prohibition and Excise Act, 2016. The allegation in brief is that there is recovery of ingredients of making illicit liquor along with 10 liters of locally made liquor with same apparatus.
Learned counsel for the petitioner submits that the petitioner is in custody since 08.11.2017 and except two cases of the Excise Act, there is no other case against him. Having considered the said facts and circumstances,
Patna High Court Cr.Misc. No.3889 of 2018 (2) dt.25-01-2018 2/2 the prayer for bail of the petitioner stands rejected in connection with Pakaridayal P. S. Case No. 04/2017 from the Court of Special Judge, Excise, Motihari.
However, the petitioner may renew his prayer for bail after framing of charge.
