JUSTICE ARUN KUMAR ORAL ORDER 09-04-2018 Heard learned counsels for the petitioner and the State. The petitioner, already in custody, seeks bail in connection with Kateya P.S.Case No. 310 of 2017 registered under Sections 395 of the Indian Penal Code.
Allegation in brief is that deity of a temple was looted by some unknown miscreants and during investigation, looted mobile of the priest of the temple was recovered from the possession of the petitioner and leading to his confessional statement idol was also recovered from Bikau.
Submission is that recovery of mobile has been planted by the police infact nothing has been recovered from the possession of the petitioner.
Whereas learned counsel for the State submits that looted mobile has been recovered from possession of the petitioner and
Patna High Court Cr.Misc. No.20791 of 2018 (2) dt.09-04-2018 2/2 leading to his confessional statement idol was also recovered from possession of another accused Bikau.
Having considered the aforesaid facts and circumstances, the prayer of bail of the petitioner is rejected. (Arun Kumar, J) Sujit/- U T
