The petitioner seeks bail in connection with Madhuban P.S. Case No.293 of 2021 registered for the offence under Sections 302/34 of the Indian Penal Code. 3.

The allegation against the petitioner is to have committed murder of son of the informant. 4.

Learned counsel appearing on behalf of the petitioner has submitted that petitioner is not named in the FIR, where, he has falsely been implicated in the present case. It has further been submitted that similarly situated co-accused persons have already been granted bail by different co-ordinate Benches of this Court through order dated 17.10.2022 passed in

Patna High Court CR. MISC. No.79751 of 2023(2) dt.19-12-2023 2/2 Cr. Misc. No. 5067 of 2022 and order dated 18.04.2023 passed in Cr. Misc. No.55270 of 2022. It is further submitted that the petitioner is a man of clean antecedent and he is in custody since 29.09.2023.

Learned APP appearing for the State, opposes the prayer for bail of the petitioner. 6.

Considering the facts and circumstances and similarly situated co-accused persons have already been granted bail by co-ordinate Bench of this Court, let the petitioner, above named, is directed to be released on bail in connection with Madhuban P.S. Case No.293 of 2021 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, East Champaran at Motihari.
