JUSTICE ARUN KUMAR ORAL ORDER 06-02-2018 Heard learned counsels for the petitioner and the State. The petitioner, already in custody, seeks bail in connection with Dighwara P.S.Case No. 201 of 2016 registered under Sections 302, 379 and 120B of the Indian penal Code and Section 27 of Arms Act.
Allegation in brief is that Manu Singh with three unknown persons entered into scuffle; in the meanwhile Manu Singh shot at his son and killed on the spot. It is alleged that due to enmity Manu Singh and his parents have murdered his son. Learned counsel for the petitioner submits that specific allegation of shooting at the deceased is against Manu Singh, named in the FIR, and petitioner is not named and due to enmity he has been falsely implicated and has clean antecedent and named accused, father of Manu Singh has been admitted to
Patna High Court Cr.Misc. No.6213 of 2018 (2) dt.06-02-2018 2/2 bail by a co-ordinate Bench of this Court vide order dated 09.05.2017 passed in Cr. Misc. No. 15602 of 2017. Having considered the aforesaid facts and circumstances, the petitioner, namely, Mohabiya Kumar Singh @ Ajay Kumar Singh, is directed to be released on bail upon furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of the learned C.J.M., Saran at Chapra in connection with Dighwara P.S. Case No. 201 of 2016.
