The matter has been taken up through video conferencing.

Let the counter affidavit filed on behalf of the respondents be kept on record.

The learned counsel for the petitioner submits that petitioner has done work worth Rs. 2,91,121/- but the respondents, the Superintending Engineer and the Executive Engineer, Building Division, Muzaffarpur have not paid the amount till date.

The learned counsel for the State has stated that in

Patna High Court CWJC No.22311 of 2019(3) dt.08-12-2020 2/2 paragraph 7 of the counter affidavit filed on 05.12.2020 the respondents have stated that as soon as fund is made available the payment shall be made.

Having considered the facts aforesaid, this writ petition is disposed of with a direction to the Executive Engineer, Building Division, Muzaffarpur to pay the admitted dues on the basis of measurement book and the verification done by the concerned engineer to the petitioner within four months from the date of receipt of this order. With the aforesaid direction, this writ petition is disposed of.
