Petitioner seeks bail in a case registered for the offence punishable under Section 364 of the Indian Penal Code. The FIR of the abduction of the husband of informant is against unknown. On recovery, statement of the victim was recorded under Section 164 Cr.P.C. He does not claim to identify to anyone of the abductor.

Learned counsel for the petitioner submits that the petitioner is in custody since 06.01.2018. On the basis of confessional statement of co-accused Sandeep Kumar Yadav name of the petitioner has surfaced. Petitioner was never put on TI Parade. Petitioner has got no criminal antecedent. Investigation of the case is already complete.

No.20142 of 2018 (2) dt.13-04-2018 2/2 Considering the entire facts aforesaid, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Sherghati Police Station Case No. 17 of 2018, subject to the condition that the petitioner shall fully cooperate with the investigation and trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
