JUSTICE BIRENDRA KUMAR ORAL ORDER 17-02-2018 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner is in custody in connection with Daudnagar P.S. Case No.321 of 2017, a case under Sections 366A/120B of the Indian Penal Code.

Allegation is that the petitioner was also involved in kidnapping of the daughter of the informant. Submission is that the victim girl had love-affairs with Sunil Yadav, the brother-in-law of this petitioner that is why the petitioner has falsely been implicated. The victim is already living with Sunil Yadav.

Considering the aforesaid submission, let the petitioner, above named, be released on bail on furnishing bail

Patna High Court Cr.Misc. No.9417 of 2018 (2) dt.17-02-2018 P2/ bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with the aforesaid case, with condition that the petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner. The petitioner shall produce affidavit of the victim at the time of filing of the bail bond, stating that she has voluntarily married with Sunil Pandey and is happy.
