The petitioner apprehends her arrest in connection with Case No. C-III 65 of 2019 registered under Sections 30(a) and 30(d) of the Bihar Excise, Act, 2016.

The accusation is that in course of raid, behind the hut of petitioner, fermented Jawa in eight containers each containing 50 KG, was recovered buried in ground, which were destroyed.

Learned counsel for the petitioner submits that it would appear from the FIR that nothing was recovered from the hut of the petitioner rather eight containers each containing 50 KG fermented Jawa was recovered behind the hut, which was

Patna High Court CR. MISC. No.68188 of 2019(2) dt.18-11-2019 2/2 destroyed by the informant. Further submission is that petitioner, who is lady, has no criminal antecedent. Having regard to the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of her arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned 2nd Additional Sessions Judge-cum-Spl. Judge (Excise), Siwan, in connection with Case No. C-III 65 of 2019, subject to the condition as laid down under Section 438(2) of the Cr.P.C.
