On the question of locus standi of the petitioner to agitate this issue, learned counsel for the petitioner has drawn the attention of this Court to paragraph No. 4 of the writ petition which states that the petitioner is a public spirited citizen having keen interest in higher education to the masses of the area.

3. This litigation is in public interest and is typically a social action litigation which cannot be entertained in the present roster.

4. In order to avoid any delay, learned counsel for the petitioner seeks permission to withdraw this petition in order to enable the petitioner to prefer an appropriate application before an appropriate forum.

5. Dismissed as withdrawn with the liberty aforesaid.
