2. Petitioners apprehend their arrest in a case registered for the offence punishable under sections 147, 149, 341 , 323 and 307 of the Indian Penal Code .
3 . As per the prosecution case , petitioner No. 1 is alleged to have assaulted husband of the informant with iron and took out Rs. 1500 cash from the pocket of husband of the informant. So far as, petitioner Nos. 2 and 3 are concerned, allegation is general and omnibus and no specific of overt act is alleged against them. Case and counter case . Petitioners claim

4. Learned counsel for the State opposed the bail petition and submitted that injury caused by petitioner No. 1 is grievous in nature .
5 . Considering the fact that injury caused by petitioner No. 1 is grievous in nature , his prayer for pre - arrest bail is rejected.
6. Considering the fact that allegation is general and omnibus and no specific of overt act is alleged against petitioner Nos. 2 and 3 , clean antecedents pf petitioner Nos. 2 and 3 and other circumstances of the case , in the event of arrest or surrender within eight weeks from today, let the petitioner Nos. 2 and 3 as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate Kishanganj in connection with Pothia P.S. Case No. 03 of 2024 , subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure . (Prabhat Kumar Singh, J) Koushik/- U
