Petitioner, already in custody, seeks bail in connection with Shambhuganj P.S. Case No.178 of 2017 (G.R. No.3678 of 2017), registered under Sections 366(A)/34 of the Indian Penal Code.

Allegation in brief is that the petitioner enticed away 13 years old daughter of the informant.

Learned counsel for the petitioner submits that the statement of the girl shows that she had voluntarily gone with the petitioner, she moved several places along with the petitioner and the petitioner is in custody since 12.01.2018; whereas the learned counsel for the State submits that she has supported the allegation in her statement and the girl is only 13

Patna High Court Cr.Misc. No.15210 of 2018(2) dt.20-03-2018 2/2 years of age, petitioner is distantly related with the girl and is a married man.

Having considered the said facts and circumstances, the prayer of bail of the petitioner is presently rejected in connection with Shambhuganj P.S. Case No.178 of 2017 (G.R. No.3678 of 2017), pending in the court of learned SDJM, Banka.

However, the trial court is directed to expedite the trial and preferably conclude the same within a year after framing of the charge.
