Petitioner apprehends arrest in connection with Bisfi (Patauna) P.S. Case No. 291 of 2022 registered for the offences under Sections 272, 273 of the Indian Penal Code and Section 30(a) of the Bihar Excise (Prohibition) Amendment Act, 2018. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in the instant case due to dirty village politics. Further submission is that the illicit wine was found in a ditch near the hand pipe under a dilapidated room. It is also submitted that nothing has been recovered from the conscious possession of the petitioner. Petitioner has no criminal antecedent.
Considering the facts and circumstances of the case
Patna High Court CR. MISC. No.74985 of 2022(4) dt.22-03-2023 2/2 and the submissions advanced on behalf of the parties, the petitioner, above named is directed to be released on bail, in the event of arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bonds of Rs.10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of Additional Sessions Judge-II-cum-Special Judge(Excise Act), Madhubani in connection with Bisfi (Patauna) P.S. Case No. 291 of 2022 subject to the conditions as laid down under section 438(2) of the Code of Criminal Procedure.
