2. The petitioner apprehends arrest in connection with Patna Mahila PS Case No.48 of 2024 dated 03.06.2024, instituted under Sections 323, 341, 506, 498-A/34 of the Indian Penal Code and Section 3⁄4 of the Dowry Prohibition Act.
3. The prosecution case, in short, is that marriage of the informant was solemnized with the petitioner according to Hindu rites and ritual in the year 2020. Thereafter, she was blessed with a male child out of the wedlock. The petitioner and his family members started demanding money and assaulting her. Petitioner is said to have demanded rupees five crore after

It is further alleged that she gave rupees eighty lakhs to her husband and father in law for purchase of flat, land and vehicle. Thereafter, she was assaulted by her husband, father-in-law, and other family members. It is also alleged that her husband has performed marriage with one Poonam Kumari.
4. Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in this case. It is further submitted that the informant is a married lady aged about 45 years and her husband's name is late Amarkant, resident of Mohalla- Bhaisasur, PS- Laheri, District- Nalanda. It is also submitted that the informant has four children out of the aforesaid wedlock and her elder daughter is aged about 21 years who has passed All India Secondary School Examination in 2018 and Xerox copy of her mark-sheet has been annexed as Annexure- P/2. It is further submitted that the informant has a bank account bearing No.42259955090 in State Bank of India, Bari Pahari Branch, Bihar sharif, in which also the name of the husband of the informant is mentioned as Amar Kant, resident of Mohalla- Bhaisasur, PS- Laheri, District- Nalanda. Learned counsel further submitted that the petitioner had good relationship with the informant's husband and after his death,
Patna High Court CR. MISC. No.80921 of 2024(2) dt.04-12-2024 3/3 due to pitiable condition, he helped the informant and his children on humanitarian ground. Marriage of the petitioner has been solemnized with one Punam Kumari on 13.05.2024 and when the informant came to know about the marriage then the present false case has been instituted. Lastly, it is submitted that the petitioner has one criminal antecedent.
5. Learned APP has opposed the prayer for bail.

Having considered the facts and circumstances of the case and submissions of learned counsel for the parties, in the event of arrest or surrender before the Court below within six weeks from today, the petitioner be released on bail upon furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, 1st Class, Patna, in Patna Mahila PS Case No.48 of 2024, subject to the conditions laid down in Section 438(2) of the Code of Criminal Procedure, 1973.
