JUSTICE ARUN KUMAR ORAL ORDER 20-03-2018 Heard learned counsels for the petitioner and the State. The petitioner, already in custody, seeks bail in connection with Kuchai Kote P.S.Case No. 284 of 2017 registered under Sections 147, 148, 149, 323, 324, 307 and 302 of the Indian penal Code.
Allegation in brief is that Ashok Shahi, Sanjay Shahi, Niranjan Shahi and Rishi Shahi assaulted Piyush Shahi, son of the informant, with knife causing his death, thereafter rest other accused persons assaulted Praveen Shahi, Ankur Shahi and Anshu Shahi.
It is submitted that there is no allegation of assaulting the deceased against the petitioner and there is general and omnibus allegation against rest accused persons for assaulting others and similarly situated two co-accused persons namely Manish Singh
Patna High Court Cr.Misc. No.15142 of 2018 (2) dt.20-03-2018 2/2 and Divyanshu Singh have been admitted to bail by a co-ordinate Bench of this Court vide order dated 21.02.2018 passed in Cr. Misc. No. 10256 of 2018 and petitioner has clean antecedent. Having considered the aforesaid facts and circumstances, the petitioner, namely, Gaurav Singh @ Gourav Singh, is directed to be released on bail upon furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of the learned Additional District Judge-8th, Gopalganj in connection with Sessions Trial No. 21 of 2018 arising out of Kuchai Kote P.S. Case No. 284 of 2017.
