JUSTICE ARUN KUMAR ORAL ORDER 20-03-2018 Heard learned counsels for the petitioners and the State. The petitioners, already in custody, seek bail in connection with Bounsi P.S.Case No. 137 of 2017 registered under Sections 308,323,341,504 and 506/34 of the Indian penal Code. Allegation in brief is that all accused persons assaulted the informant with lathi, when his brother came to rescue him, he was also assaulted.

Submission is that there is case and counter case between both sides and earlier case in point of time from the side of the petitioners, was instituted and there is no specific allegation of assault and only sole injury was found on the person of the informant and his brother, which is simple and for another injury opinion is reserved and both petitioners have clean antecedent and are in custody since 27.11.2017.

Patna High Court Cr.Misc. No.15135 of 2018 (2) dt.20-03-2018 2/2 Having considered the aforesaid facts and circumstances, the petitioners, namely , Md. Imtiyaz and Md. Sarjuddin @ Md. Sarfuddin, is directed to be released on bail upon furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of the learned ACJM-III, Banka in connection with Bounsi P.S. Case No. 137 of 2017.
