The petitioners have prayed for regular bail in a case registered for the offence punishable under section 392 of the Indian Penal Code.

As per FIR, three miscreants snatched Rs. 5,64,000/-

Patna High Court CR. MISC. No.78455 of 2023(3) dt.29-02-2024 2/3 from the informant on pistol point and fled away. Learned counsel for the petitioners submits that the petitioners are innocent and have committed no offence. The petitioners are not apprehended on the spot and they have falsely been implicated in this case merely on the basis of confessional statement of co-accused, namely, Kuldeep Yadav. Neither the petitioners are named in the FIR nor they were put on TIP. Nothing incriminating article has been recovered from their possession. Similarly situated co-accused upon whom the name of the petitioners have been dragged in this case has already been granted bail by this Court vide order dated 01.05.2023 passed in Cr. Misc. No. 6781 of 2023. It is further submitted that the petitioners are languishing in judicial custody since 13.06.2023, 10.07.2023 respectively.

Learned APP appearing for the state has opposed the prayer of regular bail.

Having heard learned counsel for the parties and considering the facts and circumstances of the case as well as custody of the petitioners, this court is inclined to enlarge the petitioners on bail. The above named petitioners are directed to be released on bail in connection with Laukaha P.S. Case No. 212 of 2022 on furnishing bail bond of Rs.10,000/- (ten
