JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER 17-01-2018 Heard learned counsel for the petitioners and learned APP for the State.

The petitioners, in the present case, are seeking regular bail in connection with Brauni (Garhara) P.S. Case No.380 of 2016, registered for offences alleged under Sections 341, 324, 307 and 120B/34 of the Indian Penal Code and Section 27 of the Arms Act.

Learned counsel for the petitioners submits that so far as the present petitioners are concerned, there is no allegation of firing against them, it is alleged in the FIR that while the informant along with one Soni Devi were returning after recording their deposition in the Begusarai Court, petitioners were also there

Patna High Court Cr.Misc. No.2913 of 2018 (2) dt.17-01-2018 on one tempo, in the way three persons came on a motorcycle intercepted the informant and at the instance of petitioners one of the persons fired causing injury. Learned counsel submits that it is case of false implication.

Learned APP opposed the prayer for bail.

Considering the facts and circumstances, let the petitioners, above named, be enlarged on bail on their furnishing bail bond of Rs.15,000/- (fifteen thousand) each with two sureties of the like amount each to the satisfaction of the learned C.J.M., Begusarai in connection with Brauni (Garhara) P.S. Case No.380 of 2016, subject to the conditions U/S 437(3) Cr.P.C. and subject to the further condition that the petitioners shall cooperate in course of trial and two consecutive defaults in putting appearance before the learned court below without any plausible reason shall lead to cancellation of their bail.
