Earlier the prayer for bail of the petitioner was rejected by this Court, vide order dated 7.8.2017 passed in Cr. Misc. No.34142 of 2017 with a direction to the learned trial court to expedite the trial.

Submission of the learned counsel for the petitioner is that two accused persons are said to have assaulted the deceased causing his death and out of them one co-accused person (Sanjay Bind) has been granted bail vide order dated 7.8.2017 passed in Cr. Misc. No.34142 of 2017 and the petitioner is in custody for about 15 months.

Heard learned A.P.P. also.

Having heard both sides and in view of the facts and

Patna High Court Cr.Misc. No.19162 of 2018 (2) dt.04-04-2018 2/2 circumstances, as stated above, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned 1st Additional Sessions Judge, Hilsa, Nalanda in connection with S.T.No.308 of 2017 arising out of Hilsa P.S.Case No.609 of 2016 with condition that he will cooperate in disposal of the trial and will also appear as and when required by the learned court below; otherwise his bail bond shall be cancelled.

With the aforesaid observation, this application is allowed.
