The petitioner seeks pre-arrest bail in connection with Parsa P.S. Case No. 70 of 2019, registered under Sections 414/34 of the Indian Penal Code, 30(a) of the Bihar Prohibition and Excise Act, 2016, and 25(1-b)a, 26 and 35 of the Arms Act. The accusation is that in course of patrolling duty, three persons were seen on Glamour motorcycle. On seeing the police party, they started to flee away, but, on chase, two persons, along with the motorcycle, were apprehended, who disclosed their name Sonu Kumar and Bittu Kumar. On search of motorcycle, two liters of country made liquor, kept in plastic bottle, recovered. Both also disclosed the name of the petitioner, who succeeded to flee away from there. Submission is that petitioner was not apprehended on

Patna High Court CR. MISC. No.67818 of 2019(2) dt.29-01-2020 2/2 spot rather his name surfaced in the confessional statement of co-accused, Bittu Kumar. Further, submission is that the petitioner has no criminal antecedent.

Having regard to the facts and circumstances of the case, let the petitioner, above named, in the event of surrender/arrest, within a period of four weeks from today, in connection with Parsa P.S. Case No. 70 of 2019 shall be released on bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of the Additional Sessions Judge XII-cum-Special Judge, Excise, Saran at Chapra, or the successor Court subject to the conditions as laid down under Section 438(2) Criminal Procedure Code.
