2. Petitioner is in custody in a case registered for the offence punishable under Sections 96, 351(3) and 3(5) of the BNS.

3. As per the prosecution case, it is alleged that petitioner has kidnapped the daughter of the informant.

4. Learned counsel for the petitioner submits that petitioner is innocent and has falsely been implicated in this case. He next submits that name of the petitioner has been surfaced only on the basis of suspicion. He next submits that from perusal of the statement of the victim recorded under Section 183 BNSS, the victim girl has stated that on 18.07.2024, she went to Chatra at the house of her friend Nancy, Muskan and Anjali where she was working in a shop and she has clearly said that she does not want to go with her parents as her parents

Patna High Court CR. MISC. No.74016 of 2025(3) dt.21-01-2026 2/2 scuffled her and her cousin also torture her. He submits that petitioner is in custody since 04.01.2025 and has got no criminal antecedent as stated in para-3 of the bail petition.

5. Learned APP for the State oppose the prayer for bail of the petitioner.

On perusal of the FIR, case diary and impugned order dated 25.06.2025 and statement of the victim recorded under Section 183 BNSS, it appears that victim herself gone with her friends and there is no allegation of abduction/kidnapping and sexual assault against the petitioner. So, considering the aforesaid facts and circumstances of the case and submission of learned counsel for the petitioner, let the above-named petitioner be released on bail, on his furnishing bail bonds of Rs.10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate in connection with Sessions Trial No. 105 of 2025/482 of 2025 arising out of Sherghati P.S. Case No.374 of 2024.
