JUSTICE VINOD KUMAR SINHA ORAL ORDER 28-02-2018 Earlier prayer for bail of the petitioner was rejected on merit vide order dated 12.07.2017 passed in Cr. Misc. No. 27101 of 2017.
Submission of learned counsel for the petitioner is that the instant application has been renewed on the ground that seven witnesses have been examined in this case and they have been declared hostile and only four witnesses are yet to be examined.
Heard learned A.P.P. also.
Having heard both sides, considering the facts and circumstances of the case, I am not inclined to release the petitioner on bail, this application is accordingly dismissed. However, since the case is pending only for
Patna High Court Cr.Misc. No.8833 of 2018 (2) dt.28-02-2018 2/2 evidence of four witnesses, the trial court is directed to conduct the trial on day to day basis and conclude the same within a reasonable period.
At the same time, S.P. Muzaffarpur is directed to ensure the production of witnesses in the trial court on the date fixed, so that the trial be concluded expeditiously.
