2. The petitioner has prayed for regular bail who is in judicial custody in a case registered for the offence punishable under sections 302, 120(B) and 34 of the Indian Penal Code.

3. As per the FIR, informant alleged that the petitioner committed murder of her brother, namely, Nilesh Kumar who died in the house of this petitioner as the petitioner and the deceased were working together for shooting of song.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. He has falsely been implicated in this case. Only on the basis of suspicion, he has been dragged in this case. There is no eye witness of the alleged occurrence and also nothing consistent

5. Learned APP appearing for the state has opposed the prayer of regular bail and submitted that petitioner is named in FIR and postmortem report corroborates with the prosecution version.

6. Having heard learned counsel for the parties and considering the facts and circumstances of the case as well as custody of the petitioner, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Ara Town P.S. Case No. 998 of 2022 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bhojpur at Ara.
