JUSTICE ARUN KUMAR ORAL ORDER 03-04-2018 Heard learned Counsel for the petitioner and the State. Petitioner, already in custody since 11.12.2017, seeks bail in Shrinagar (Pujahan) PS Case No. 160 of 2017 registered under Sections 363, 366(A)/34 of the IPC and Section 8 of the Pocso Act. The allegation in brief is that the petitioner enticed away daughter of the informant.

Learned Counsel for the petitioner submits that it is a case of elopement as the girl has stated so in her statement, she is major of 19 years of age and as per Medical Board her age is between 17-18 years and she has also expressed her desire to go with the petitioner as she is also pregnant.

Having considered the said facts and circumstances, the petitioner, namely, Chhabila Mukhiya @ Chhabila Kumar is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Sessions Judge Ist -cum- Special Judge, Bettiah, West Chyamparan in connection with Shrinagar (Pujahan) PS Case No. 160 of 2017.
