JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 04-07-2023 Heard learned counsel for the petitioner, learned counsel for the informant and learned APP for the State. The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 302, 34 of the Indian Penal Code.
As per FIR, the allegation against accused persons including this petitioner is that they committed murder of the informant's son and threw his dead body in a field. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. He has falsely been implicated in this case due to dirty village politics. He has got no criminal antecedent and it is a case of last scene. It is further submitted that the petitioner is
Patna High Court CR. MISC. No. 1482 of 2023(3) dt.04-07-2023 2/3 languishing in judicial custody since 09.06.2022. Learned APP appearing for the state and learned counsel for the informant opposed the prayer of regular bail and submitted that trial against the petitioner is in progress and many witnesses have been examined. It is submitted that the petitioner confessed his guilt of committing murder, which is mentioned at para 43 of the case diary and at the instance of his self confession, cloth of the deceased was recovered. During investigation several witnesses supported the prosecution version and stated that they had seen throwing the dead body of the informant's son. Having heard the learned counsel for the parties and considering the facts and circumstances that there is direct allegation against the petitioner of committing murder, this court is not inclined to enlarge the petitioner on bail and, as such, his prayer for bail stands rejected. The trial Court is directed to expedite the trial and conclude the same as soon as possibe.
