2. The petitioner apprehends his arrest in connection with Rani Talab P.S. Case No. 94 of 2022, dated 28.05.2022, registered for the offences punishable under Sections 341, 323, 307, 504 and 506 read with Section 34 of the IPC and Section 27 of the Arms Act.
3. As per allegation in the FIR, on account of some dispute between the informant and his neighbour, Ram Dhayan Yadav, an occurrence took place on 25.05.2022 at 09:00 PM, wherein co-accused Brajesh Yadav indulged in abuses, assault and even fired from his pistol which injured the informant.
4. Learned counsel for the petitioner submits that it would be apparent from the FIR that the entire allegation is

No.76900 of 2025(2) dt.27-11-2025 2/3 confined to Brajesh Yadv, who is said to have indulged in abuses, assault and even firing and the name of the present petitioner has only been taken stating the fact that he was also seen standing near the tree with no overt act alleged upon him. It is further submitted that after investigation no chargesheet was submitted against the present petitioner and subsequently in the trial of co-accused Brajesh Yadav, after examination of seven prosecution witnesses, the petitioner was summoned under Section 319 of the Cr.P.C., whereafter his trial was separated. It is also pointed out that trial of co-accused Brajesh Yadav has already resulted in an acquittal vide Annexure-4 to the present bail petition.
5. Learned Additional Public Prosecutor for the State on the other hand vehemently opposes the prayer for grant of anticipatory bail to the petitioner.

Taking into consideration the facts and circumstances of the case and further considering the fact that the petitioner has been made an accused on the basis of summons issued under Section 319 of the Cr.P.C., while originally there was no chargesheet against him, coupled with the fact that the main accused on whom the allegation rests has already been acquitted, let the petitioner, above-named, in the

No.76900 of 2025(2) dt.27-11-2025 3/3 event of his arrest or surrender before the Court concerned within a period of four weeks, be released on anticipatory bail, on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand Only) with two sureties of the like amount each to the satisfaction of learned Additional Session Judge-III, Danapur, Patna, in connection with Rani Talab P.S. Case No. 94 of 2022, subject to the conditions laid down under Section 438(2) of the Cr.P.C. / Section 482(2) of the BNSS.
