JUSTICE VINOD KUMAR SINHA ORAL ORDER 25-10-2019 This application, for grant of anticipatory bail, arises out of Barhariya P.S. Case No. 148 of 2019, disclosing offences under Sections 304(B)/34 of the Indian Penal Code. Petitioner happens to be cousin father in law and cousin mother in law and allegation against them and others is of causing death of the deceased by strangulating her in connection with demand of dowry.

Submission of learned counsel for the petitioners is that they are cousin father in law and mother in law and they have falsely been made accused in this case and no specific allegation has been attributed to them and they are residing separately.

Patna High Court CR. MISC. No.67984 of 2019(2) dt.25-10-2019 2/2 Heard learned A.P.P. also.

Having heard both sides, in view of the above facts, this application is allowed. Let the petitioners, above named, in the event of their arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty five Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Siwan, in connection with Barhariya P.S. Case No. 148 of 2019, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure. It is with further subject to the condition that petitioners have to cooperate in investigation and appear before the Investigating Officer as and when required and after enquiry, if any serious incriminating material comes against the petitioners, prosecution will be at liberty to move for cancellation of their bail bonds.
