The petitioner seeks pre-arrest bail in connection with Belchhi P.S. Case No.44 of 2016 registered under Sections 147, 148, 149, 341, 323, 504, 353 and 427 read with 34 of the Indian Penal Code.
It is submitted by the learned counsel for the petitioner that one Vinod Saw having exactly identical allegation has already been granted pre-arrest bail by a Bench of this Court dated 19.09.2017 vide Cr. Misc. No.42961 of 2017, as contained in Annexure-2 to the present petition. It is further submitted that several other co-accused have already been granted pre-arrest bail by different Benches of this Court.
Patna High Court Cr.Misc. No.22285 of 2018 (2) dt.27-04-2018 2/2 Learned counsel for the State does not dispute the aforesaid contention of the learned counsel for the petitioner. Considering the submissions made above, keeping in mind the reasons assigned in the order dated 19.09.2017 passed in Cr. Misc. No.42961 of 2017, as contained in Annexure-2 series, in the event of arrest or surrender in the court below within six weeks from today, the petitioner is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate, Barh in connection with Belchhi P.S. Case No.44 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. (Ashwani Kumar Singh, J) Md.S./- U T
