ANJANA MISHRA ORAL ORDER 24-01-2020 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is apprehending his arrest in connection with Pusa P.S. Case No.89 of 2019 registered for the offence punishable under Sections 30(A) and 41(2) of Bihar Prohibition and Excise Act, 2016.

Learned counsel for the petitioner submits that only because the fertilizer godown from where the alleged recoveries are said to have been made and the petitioner being the owner, he is apprehending his arrest. It is submitted that the alleged recoveries were not from the conscious possession of the petitioner and he is victimized in the present case. The petitioner is not having any criminal antecedent.

No.74081 of 2019(2) dt.24-01-2020 2/2 Considering the aforementioned facts and circumstances and that the petitioner is having no criminal antecedent, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned 2nd Additional Sessions Judge-cumSpecial Judge, Excise, Samastipur in connection with Pusa P.S. Case No.89 of 2019.
