2. The present petition has been preferred for the grant of following relief(s):

"(i) for quashing the Notice dated 18.07.2025 and its consequential effects in Jamabandi Cancellation Case No. 683 of 202526(The State through Circle Officer, Mashrak Vs.

2/4 Nageshwar Singh) issued by the Additional Collector, Saran at Chapra (Respondent No. 5) [Annexure-P-5] whereby and where under the said respondent directed to the petitioner to file document/11.09.2025 in Jamabandi evidence by to Cancellation Case initiated relating cancellation of Jamabandi No. 467 running in the name of Nageshwar Singh (Petitioner) relating to a subject land situated under Revenue village-Mashrak (Gopalbari) its Revenue Thana No. 139, connecting Khata No. 533, (Survey Plot/Khesra not mentioned) admeasuring in Area of 02 Bigha under Revenue Circle/BlockMashrak in the District of Saran. (ii) for directing the respondents to not disturb the peaceful possession of the petitioner upon the abovementioned subject land situated under Khata No. 533, Survey Plot/ Khesra 11657, admeasuring in Area of 2 bigha under Jamabandi No. 467 which is running in the name of Petitioner on the basis of settlement/Hukumnama made by the Ex-

3/4 intermediary Sri Babu Harihar Sharan Ji and others Estate issued by his competent authority in view of the same vide Tauzi No. 2425, Lagan has been submitted by the Ancestor of the petitioners. The said Jamabandi is running since very long which has been protected by mandates of Hon'ble Court passed in a cases of Ramanandan Singh Vs. The State of Bihar, Jagarnath Jha Vs. the State of Bihar, Nathuni Singh and others Vs. the State of Bihar and others, Bhola Das Vs. State of Bihar, Ramnaresh Roy and others Vs. The State of Bihar and others and Ramowatar Lakhotia Vs. The State of Bihar and others as well as resolution of Department of Revenue and Land Reforms, Government of Bihar captioned in Memo No. 925 dated 11.11.2014.

(iii) and any other writ(s), order(s), direction(s) to which the petitioners which may deem just proper and necessary in view of the facts and circumstances discussed herein under."

3. After some argument, learned counsel for the

4/4 petitioner submits that he shall be answering to the notice that has been sent to him by the office of the respondent no.5, the Additional Collector, Saran at Chapra.

4. Learned State counsel submits that once the reply is filed, the matter shall be taken to its logical conclusion.

5. In that background, the writ petition is disposed of allowing the petitioner to reply to the notice sent to him by the respondent no.5, the Additional Collector, Saran at Chapra, who shall be taking up the matter and after hearing all the parties, dispose it of at an earliest.
