2. The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 341, 307, 504, 506, 120(B)/34 of the Indian Penal Code, 27 of the Arms Act and section 3/4 of the Explosive Act.
3. As per prosecution case, the accused persons including the petitioner are alleged to have arrived at the house of the informant, thereafter they had resorted to indiscriminate firing and had kept a home made bomb in front of the house of the informant.
4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. He has
Patna High Court CR. MISC. No.78110 of 2023(2) dt.06-12-2023 2/2 falsely been implicated in this case due to his criminal antecedents. The petitioner was remanded in this case from Barauni P.S. Case No. 438 of 2022. No any cogent material has come against the petitioner. It is further submitted that the petitioner is languishing in judicial custody since 21.10.2022.
5. Learned APP appearing for the state has opposed the prayer of regular bail.
6. Having heard learned counsel for the parties and considering the facts and circumstances of the case as well as custody of the petitioner, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Nawkothi P.S. Case No. 184 of 2021 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge 2nd, Begusarai.
