2. The petitioner has filed the present writ petition for the following relief/s :- "(I) For setting aside the order passed by the District Officer, Samastipur on 06.10.2022 by which the petitioner's contract to work as Mahila Paryavekshika,Child Development Project, Khanpur has been terminated.

(II) For any other relief/reliefs to which the petitioner may be found to be entitled to."

3. Learned counsel appearing on behalf of the petitioner submits that this Court had granted interim protection to the petitioner vide order dated 13.03.2023, which is continuing.

4. Learned counsel appearing for the State submits that the controversy involved in the present writ petition would be effectively resolved only after the final adjudication of Anganwari Second Appeal No. 18 of 2022, which is presently pending before the competent authority.

It has been jointly submitted by the learned counsel for the parties that the present writ petition may be disposed of with a direction to respondent No. 3, namely, the Divisional Commissioner, Darbhanga, to decide Anganwari Second Appeal No. 18 of 2022 within a stipulated time, whereupon the dispute between the parties would stand substantially resolved.

In view of the joint submissions advanced on behalf of the parties, respondent No. 3, namely, the Divisional Commissioner, Darbhanga, is directed to consider and dispose of Anganwari Second Appeal No. 18 of 2022 by passing a reasoned and speaking order, in accordance with law, as expeditiously as possible, preferably within a period of 90 days from the date of receipt/production of a copy of this order. The

Patna High Court CWJC No.433 of 2023 dt.28-07-2026 3/3 aforesaid period shall commence from the date of completion of appearance of all the parties in the appeal proceedings.

7. Till the final disposal of Anganwari Second Appeal No. 18 of 2022, if not disposed of, the interim protection granted to the petitioner vide order dated 13.03.2023 shall continue to remain in force.

8. With the aforesaid observations and directions, the present writ petition stands disposed off.
