It is informed by Mr. Lokesh Kumar Singh, learned counsel appearing on behalf of the petitioner that in Cr. Misc. No. 66099 of 2022 arising out of the same P.S. Case number of the present case, this Court had called for a report with respect to stage of the trial vide order dated 30.11.2022 and the trial court submitted a report informing that the two witnesses are remaining to be examined. The order dated 04.01.2023 passed in Cr. Misc. No. 66099 of 2022 is reproduced as under: "Heard Mr. Lokesh Kumar Singh, learned counsel appearing on behalf of the petitioner and Mr. Abhay Kumar, learned APP for the state.

The petitioner had earlier moved before this Court for grant of bail which was rejected vide order dated 18.04.2022

Patna High Court CR. MISC. No.1342 of 2023(2) dt.11-01-2023 2/2 passed in Cr. Misc No. 39172 of 2021. A report was called for from the trial court vide order dated 30.11.2022. It has been informed by the Additional District and Sessions Judge-V, Gopalganj that only two witnesses are remaining to be examined.

In such circumstances, the Superintendent of Police, Gopalganj is directed to produce the two remaining witnesses on the next date fixed by the trial court to get examined.

The trial court is directed to conclude the trial expeditiously preferably well within a period of three months.

Accordingly the present application is disposed of."

Learned counsel further submitted that the present case may also be disposed of in light of the order dated 04.01.2023 passed in Cr. Misc. No. 66099 of 2022. Accordingly, the present bail application stands disposed of in the light of the observation made in the Cr. Misc. No. 66099 of 2022.
