Petitioner, already in custody, seeks bail in connection with Barun P.S. Case No.148 of 2014, registered under Sections 302/34 of the Indian Penal Code as well as under Section 27 of the Arms Act.

Learned counsel for the petitioner submits that there is no specific overt act of shooting or assaulting against the petitioner, the police not finding his involvement did not sent up the petitioner for trial but has been summoned under Section 319 Cr.P.C. and Kunal Kumar, who is said to have shot at the deceased has been admitted to bail by a coordinate Bench of this Court by order dated 13.12.2017, passed in Cr. Misc. No.58796 of 2017.

No.10961 of 2018(2) dt.23-02-2018 2/2 Having considered the said facts and circumstances, petitioner Shashi Prajapati @ Shashi Kumar is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Ad hoc Additional District & Sessions Judge-VII, Aurangabad in connection with Barun P.S. Case No.148 of 2014, giving rise to Sessions Trial No.50 of 2015/532 of 2017.
