JUSTICE SHIVAJI PANDEY ORAL ORDER 27-05-2020 Heard learned counsel for the petitioner and learned counsel for the State through virtual court proceeding. In this case, the petitioner is seeking bail in connection with Kumarkhand P.S. Case No. 58 of 2019 registered for offences under sections 420, 489(B), 489(C) of the Indian Penal Code.
As per prosecution case, the police made a raid on the house of the petitioner and recovered the fake currency amounting Rs. 21,600/- of different denominations from the possession of the petitioner.
The petitioner has remained in judicial custody since 4.4.2019.
The other identical accused persons from whom also the fake currency was recovered have been granted bail by
Patna High Court CR. MISC. No.67532 of 2019(5) dt.27-05-2020 2/2 this Court vide order dated 14.11.2019 passed in Cr. Misc. No. 63690 of 2019.
Looking to the period of custody as also considering the present situation arising out of Covid-19 outbreak, let the petitioner, above named, be released on bail on furnishing personal bail bond to the satisfaction of learned Sub-Divisional Judicial Magistrate, Madhepura in connection with Kumarkhand P.S. Case No. 58 of 2019, subject to the condition that if the petitioner is found involved in future in similar type of offenses, the prosecution will be at liberty to make prayer for cancellation of his bail and the court below will pass necessary order, including cancellation of bail granted to the petitioner.
