JUSTICE RUDRA PRAKASH MISHRA ORAL ORDER 18-03-2024 Heard learned counsel for the petitioner and learned APP for the State. Perused the case diary. A supplementary affidavit has been filed on behalf of the petitioner, the same be kept on record.

2. The petitioner seeks bail in Karakat P.S. case No. 130 of 2023 instituted for the offences under Sections 302, 201/34 of the Indian Penal Code.

3. Prosecution case, in brief, is that the daughter of the informant was tortured by her in-laws and thereafter committed her murder on account of non-fulfillment of demand of dowry.

4. Learned counsel for the petitioner submits that

Patna High Court CR. MISC. No.77011 of 2023(4) dt.18-03-2024 2/3 the petitioner is innocent and has falsely been implicated in the present case. Charge-sheet has been submitted in this case. General and omnibus allegation has been made against the petitioner. No specific overt act is alleged against the petitioner. Learned counsel for the petitioner further submits the petitioner is father-in-law of the deceased. He is separate in mess and property from the husband of the deceased. The husband of the deceased in custody. The petitioner is 70 years old person suffering from old age ailments. The petitioner is in custody since 17.05.2023 and has no criminal antecedent.

6. Learned A.P.P. for the State has vehemently opposed the prayer for grant of bail to the petitioner.

6. Considering the aforesaid facts and circumstances of the case, the period of custody undergone by the petitioner and the old age of the petitioner, this Court is inclined to grant bail to the petitioner.

7. Let the petitioner be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Court below/concerned Court in connection with Karakat
