04-04-2018 Heard Sri Hari Kishore Thakur, learned counsel for the petitioner and Smt. Sharda Kumari, learned Addl. Public Prosecutor.

The sole petitioner, who is in custody since 03-04-2017 in Hathauri P.S. Case No. 4 of 2017 registered for offence under Sections 272, 273 and 290 of the Indian Penal Code and Section 30(a) of Bihar Prohibition and Excise Act, 2016, has renewed his prayer for bail, on the ground that even after expiry of one year of custody of the petitioner, no adequate progress has taken place in the case. He submits that his prayer for bail was earlier rejected on 15-09-2017, vide Cr. Misc. No. 41425 of 2017.

Considering the fact that petitioner is in custody since 03-04-2017 and no adequate progress has taken place, as

No.19412 of 2018(2) dt.04-04-2018 2/2 submitted by learned counsel for the petitioner, let the petitioner namely Sudhir Mandal be enlarged on bail on furnishing bailbond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise Act, Muzaffarpur in connection with Hathauri P.S. Case No. 4 of 2017.
