The petitioner seeks bail in connection with Gadhpura P.S. Case No.05 of 2018 registered under Sections 385 and 392 of the Indian Penal Code.
Learned counsel appearing on behalf of the petitioner submits that it would appear from the F.I.R. that on the basis of the written report of the informant, the present case was lodged against one Lalua and some unknown. In course of investigation, the name of the petitioner surfaced in this case in the confessional statement of the co-accused Chandan Kumar Rai and, thereafter, the petitioner was remanded in the present case on 28.04.2018 and since then he is in custody. While the
Patna High Court CR. MISC. No.68423 of 2019(2) dt.14-01-2020 2/2 informant has claimed in the F.I.R. to identify the culprits on seeing them again but the petitioner has not been put on T.I. Parade till date. The petitioner has no criminal antecedent. Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the 4th Additional Chief Judicial Magistrate, Begusarai, in connection with Gadhpura P.S. Case No.05 of 2018.
