2. The petitioner has prayed for regular bail in a case registered for the offence punishable under section 395 of the Indian Penal Code.
3. The case of prosecution, in brief, is that on 14.12.2020 at night, some unknown miscreants entered the house of the informant and made captive him and his family members. Thereafter, they looted jewelery, TV, mobile phones and cash and fled away.
4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. The petitioner is not named in the FIR. His name came into light on the basis of mobile tracking. Neither the petitioner was put on
Patna High Court CR. MISC. No.76769 of 2023(4) dt.27-02-2024 2/2 TI Parade nor any incriminating article has been recovered from his conscious possessions. Similarly situated co-accused namely, Hriday Paswan has already been granted bail by a coordinate Bench of this Court vide order dt. 9.9.2022 passed in Cr. Misc. No. 19671 of 2022. It is further submitted that the petitioner is languishing in judicial custody since 26.6.2023.
5. Learned APP appearing for the state has opposed the prayer of regular bail.
6. Having heard learned counsel for the parties and considering the facts and circumstances of the case as well as custody of the petitioner, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Wazirganj P.S. Case No. 574 of 2020 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned ACJM 1st Gaya.
