Petitioner, already in custody, seeks bail in connection with Ram Nagar P.S. Case No.259 of 2017, registered under Sections 420, 468, 471, 120B and 419/34 of the Indian Penal Code. Allegation in brief is that the complainant's land, which was settled with him as a lease holder, a part of it is alleged to have been sold by the petitioner to other co-accused. Learned counsel for the petitioner submits that the land in question was settled in favour of the petitioner in the year 1948 by the then Jamindar and mutation was also done and the petitioner is paying rent, so claiming the title and right over the said land and sold the land to other co-accused, so the case is not lodged by the purchaser but by other person claiming the
Patna High Court Cr.Misc. No.9551 of 2018(2) dt.17-02-2018 2/2 right on the land on the basis of lease and the petitioner is in custody since 09.01.2018.
Having considered the said facts and circumstances, petitioner Chintamani Tiwari @ Nathuni Tiwari is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Bagaha, West Champaran in connection with Ramnagar P.S.
