Petitioner apprehends his arrest in a case registered for the offence punishable under sections 420,467,468,471,474 of the Indian Penal Code.

As per the prosecution case, the informant alleged that for the employment on the post of Technical Assistant under Panchayat Raj Department this petitioner has applied along with certain certificate which were found to be forged and fabricated and hence FIR was lodged against this petitioner. Learned counsel for the petitioner submits that no forged and fabricated document has been submitted by the petitioner rather the petitioner himself had filed a complaint case no. 1676 of 2019 before the learned Court of C.J.M. Gopalganj against the University concerned. It is further

Patna High Court CR. MISC. No.71651 of 2019(2) dt.20-11-2019 2/2 submitted that petitioner has committed no offence. It is further submitted that petitioner is a student having clean antecedent. To his knowledge, all documents which were annexed by him were genuine.

Learned counsel for the State opposes the prayer for bail. In the aforesaid facts and circumstances of the case, let the above named petitioner be released on bail in the event of his arrest or surrender before the Court below within a period of six weeks from the date of receipt of the order, on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Gopalganj, in Thawe Police Station Case No.91 of 2019, on the following conditions:-

(1) Petitioner shall co-operate in the trial and shall be properly represented on each and every date fixed by the Court and shall remain physically present as directed by the Court and his absence on two consecutive dates without sufficient reason, his bail bond shall be cancelled by the Court below.

(2) If the petitioner tampers with the evidence or the witnesses, in that case the prosecution will be at liberty to move for cancellation of bail of the petitioner.
