The petitioner seeks bail in a case registered for the offence punishable under Sections 30(a), 32(1), (3), 41(a), 41(2) of Bihar Prohibition and Excise Act.

Allegedly 20 liters of illegal wine was recovered. Learned counsel for the petitioner submits that no illegal wine was recovered from the conscious possession of the petitioner rather it was recovered from the back seat of the motorcycle. He further submits that petitioner has got clean antecedent and is in custody since 26.08.2019. In the facts and circumstances of the case, let the petitioner above named be released on bail on furnishing bail

Patna High Court CR. MISC. No.70627 of 2019(2) dt.25-11-2019 2/2 bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge Excise, Patna, District-Patna in connection with (Govt. Official) P.R.Case No.170 of 2019 (Special Case No.7683 of 2019), subject to condition that the petitioner will deposit Rs.5,000/- (five thousand) in the Nazarat Civil Court, Patna such deposit of Rs.5,000/- (five thousand) shall abide by the out-come of the present case.
