Petitioner, in the present case, is seeking regular bail in connection with Chakia P.S. Case No. 268 of 2017 corresponding to G.R. No. 6321/2017 registered for the offence punishable under Sections 379/411 of the Indian Penal Code.
Learned counsel for the petitioner submits that as per F.I.R. while the informant was withdrawing money from the SBI ATM, this petitioner pushed him aside and wanted to flee away with a sum of Rs. 16,000/- which belonged to the informant. The informant raised hulla on which the petitioner was chased and apprehended. Learned counsel submits that in fact this petitioner and his cousin have got accounts in the SBI and he had gone to withdraw
Patna High Court Cr.Misc. No.4864 of 2018 (2) dt.02-02-2018 money there but because of some dispute with the informant he has been falsely implicated in this case. Learned counsel refers the seizure list which shows recovery of ATM Card in the name of this petitioner. It is further stated that he has no criminal history. Learned Additional Public Prosecutor for the State opposes the prayer for bail of this petitioner. Considering the facts and circumstances particularly that petitioner has no criminal history, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs. 15,000/- (Rupees fifteen thousand only) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M. - 13, Motihari, East Champaran, in connection with Chakia P.S. Case No. 268 of 2017 corresponding to G.R. No. 6321/2017, subject to condition as laid down under Section 437(3) of the Code of Criminal Procedure and further condition that if he is found involved in similar offence again the Investigating Officer is at liberty to move for cancellation of bail.
