The petitioner in this case is seeking regular bail in connection with Kuchaikote P.S. Case No. 228 of 2019 registered for the offences punishable under Sections 406, 409, 420, 120(B) of the Indian Penal Code, Sections 30(a0, 41(1), 48 of the Bihar Prohibition & Excise Act.

Learned counsel for the petitioner submits that the petitioner has not been apprehended with any liquor rather his name transpired in the confessional statement of co-accused in the capacity of trader of illicit liquor and except the same nothing has come against the petitioner to involve him in the alleged occurrence. He is in custody since 20.08.2019. Learned APP has opposed the prayer of bail.

Considering the facts and circumstances of the case

Patna High Court CR. MISC. No.68507 of 2019(2) dt.04-12-2019 2/3 wherein it appears that name of this petitioner transpired in the statement of Chaukidar Munna Kumar Rai as the person to whom he had delivered the illicit wine and it is a case in which the police authorities including this petitioner were allegedly involved in showing lesser quantity of seizure of illicit liquor and selling of the liquor and then they have been granted regular bail by a learned co-ordinate Bench of this court in Cr. Misc. No. 66746 of 2019 and Cr. Misc. No. 65984 of 2019, the petitioner is in custody since 20.08.2019 and the investigation is complete, let the petitioner above named be released on bail in connection with Kuchaikote P.S. Case No. 228 of 2019 on furnishing of bail bond of Rs.

15,000/- (fifteen thousand) with two sureties of the like amount each to the satisfaction of learned 2nd Additional Sessions Judgecum-Special judge, Excise, Gopalganj, subject to the condition as laid down under Section 437 (3) Cr.P.C.
