JUSTICE ARUN KUMAR ORAL ORDER 19-04-2018 Heard learned counsels for the petitioner and the State. The petitioner, already in custody, seeks bail in connection with Mahila P.S.Case No. 13 of 2017 registered under Sections 354B, 376, 448, 511 and 506 of the Indian penal Code.

Allegation in brief is that petitioner made an attempt to rape the prosecutrix in the night while she was sleeping along with her children.

Submission is that petitioner is Bataidar of the informant's husband and has falsely been implicated in this case because he wanted to remove from Badaidari and the informant herself is a married lady and many witnesses have not supported the alleged occurrence.

Having considered the aforesaid facts and circumstances,

Patna High Court Cr.Misc. No.23109 of 2018(2) dt.19-04-2018 2/2 the petitioner, namely , Rajdeo Mahto, is directed to be released on bail upon furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of the learned CJM, East Champaran, Motihari in connection with Mahila P.S. Case No. 13 of 2017.
