1. Heard learned Counsel for the petitioners and learned Additional Public Prosecutor for the State.
2. This application, for grant of anticipatory bail, arises out of G.B. Nagar Police Station Case No. 174 of 2025, disclosing offences under Sections 191(2), 126(2), 115(2), 118, 109, 303(2), 324(A), 352, 351(2) of the BNS, 2023.
3. As per the FIR, on 25.04.2025, when the informant arrived near the road of his house, his co-sharers, petitioners and others stopped the passage of the informant and

When the informant objected, petitioners and other accused persons assaulted the informant with lathi, danda, knife, etc. When the informant's son Sanjay Kumar Prasad arrived to save the informant, they also assaulted his son. The petitioner no. 3 assaulted the son of the informant by means of knife on his hand.
4. Learned counsel for the petitioners submits that both the parties are co-sharers and there is a land dispute between them. A counter case bearing G.B. Nagar PS Case No. 177 of 2025 has been lodged by the side of the petitioners against the informant and others. The allegations against the petitioners are general and omnibus in nature. The injuries caused to the informant are simple in nature except one injury caused on his hand which has been opined as grievous. The injury caused to the informant's son is simple in nature.

Having regard to the submissions made on behalf of the parties and taking into consideration the fact that both the parties are co-sharers having land dispute, case and counter case is there, injuries sustained by the informant's son and the informant are simple in nature except one injury on the hand of the informant which is non-vital part of the body, I am

6. This application is, accordingly, allowed.
7. Let the petitioners, above named, in the event of their arrest or surrender before the Court below within four weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Siwan, in connection with G.B. Nagar Police Station Case No. 174 of 2025, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure/Section 482(2) of the BNSS, 2023.
