JUSTICE ARUN KUMAR ORAL ORDER 17-02-2018 Heard learned counsels for the petitioner and the State. The petitioner, already in custody, seeks bail in connection with Fatehpur P.S.Case No. 231 of 2016 registered under Sections 380 and 457 of the Indian penal Code.

Allegation in brief is that some unknown miscreants committed theft of Rs. 12,09,300/- after breaking open ATM cash box.

Submission is that except disclosure of the name of the petitioner by one Bali Bhuiyan, there is no other material and no incriminating article has been recovered from the possession of the petitioner and Bali Bhuiyan and other similarly situated have been admitted to bail by a co-ordinate Bench of this Court vide order dated 09.02.2018 passed in Cr. Misc. No. 7973 of 2018 and order dated 17.01.2018 passed in Cr. Misc. No. 57480 of 2017 and

Patna High Court Cr.Misc. No.4219 of 2018 (3) dt.17-02-2018 2/2 against accused persons investigation is completed and petitioner is in custody since 25.08.2017.

Having considered the aforesaid facts and circumstances, the petitioner, namely, Kamlesh Kumar, is directed to be released on bail upon furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of the learned CJM, Gaya, in connection with Fatehpur P.S.
